The Legal Committee of the Coalition of Low Wage & Immigrant Worker Advocates (CLIWA) - of which Worksafe is a member - is working to to help car wash workers and improve their working conditions. The effort is led by the Community-Labor-Environmental Action Network (CLEAN) and supported by legal services organizations, community-based groups, and others. Please attend this wage and hour training If you are interested in representing car wash workers before the Labor Commissioner in state court. 3.5 hours of MCLE credit will be provided.

Work Comp for Legal Services Programs - Assisting Injured Workers This program is directed at legal services programs or worker organizations that want to know more about the workers' compensation system. Special emphasis is placed on workers' comp for low income and immigrant workers. The focus is on assisting injured workers who cannot retain an attorney so they might secure medical care or temporary disability.
The program includes substantive information about workers' compensation eligibility and "how to" guidance on topics sucah as filing a claim, getting medical treatement for a workplace injury, etc. It also covers how to incorporate workers' compensation into a legal services program.
This 2 hour program can stand alone or be presented at the same time as the workers' compensation retaliation program described below. Written materials are provided. These include a manual with fact sheets and sample letters as well as a powerpoint.
We can also condense both trainings into a VERY quick-talking 2 1/2 hours.
MATERIALS: For the basic work comp program, we provide a detailed manual with fact sheets, sample letters and a power point presentation which legal services can use for client workshops on workers' compensation. Most importantly, we want to work with your legal services office to design a program to assist injured workers that meets your specific needs. Discrimination & Retaliation Claims related to Workplace Injuries - This program is directed at legal services programs or worker organizations that want to know assist injured workers who suffer retaliation or discrimination because they exercise their rights under the workers' compensation system or who are simply fired as a result of their injury. The program outlines options for injured workers whose employers have retaliated or discriminated against them for exercising rights to workers' compensation or because of their on-the-job injuries. You will learn how to file Labor Code 132a petitions, and to identify and pursue disability discrimination claims related to on-the-job injuries (FEHA or other claims).
This 1 hour program can stand alone or be presented at the same time as the workers' compensation general overview described above. Written materials will be provided during this program.

Understanding Toxics Program is directed at legal services providers who are working on toxics issues (eviction defense, affirmative cases against slum landlords, environmental hazards affecting low income communities, etc.) and need to know something about toxicology. The program includes substantive information about particular substances upon request, eg. for housing, information can be provided regarding arsenic (in playground wood), asbestos, lead, mercury in light fixtures, mold, radon, pesticides & fumigants, residues from cleaning supplies, etc.).
